The seventh Actos case out of thousands went to trial recently.

Frances Wisniewski, a 79-year old retired accountant, received a $2 million verdict. The jury found Actos contributed to Wisniewski’s bladder cancer.

This case follows a $9 billion verdict and is the second heavy-hitting verdict against Actos.

Actos Connection to Cancer Presented at Trial

Actos users claim Takeda, the manufacturer of the drug, either ignored or downplayed Actos’ cancer-causing risks. They claim the company knew the risks before it ever went on the market in the US.

At trial, attorneys presented evidence that Takeda officials even destroyed documents. That evidence exposed their knowledge of the risks during the development, marketing, and sales of Actos.

Most drugs come with side-effects, and some are more dangerous than others. To protect the public from injury, manufacturers must fully disclose all potential risks and side-effects. If the drug company fails to do so, especially if the company fails to do so intentionally, then the company should be held liable for the damages.
