Hello I’m Darrell Castle. I’m an attorney licensed to practice law in the state of Tennessee and I’m going to be doing a series of videos on Social Security Disability.

This is the first video in the series and this is just a general introduction into what Social Security Disability really is.

First of all – what it’s not…

It’s not an employment compensation plan. It’s not a plan where if you’re in a bad economy and lose your job and you get compensated for that. No, that’s not what it is.

Disabillity under Social Security Administration rules means that you are unable to work because of your medical condition. Under their rules, you are unable to work #1, if you cannot do the work you could do before, and #2, the Social Security Administration determines that you cannot adjust to a different kind of work because of your medical condition. And #3, your inability to work has lasted, or is expected to last for a year or more or to result in your death.

Now, those are the primary determiners for determining if you are disabled or not, but what about the year? What’s that about? Why would they make you wait for a year? How are you supposed to survive for a year?

Well the Social Security Administration believes that you should have other sources of income to help you survive for a year – things like: short term disability from your company, workers’ compensation, savings, investment or family help. Those types of things will help you get by for the first year

Now, you’ve had to have worked long enough to earn Social Security work credits to qualify and that is the subject for our next video.
