CPAP Injury Leaves Victims Restless

If you suffer from sleep apnea, you’ve probably heard about the CPAP machine recalls. And if so, you know the feeling of choosing between a safe night’s rest and getting a serious injury from your machine. CPAP injury has affected thousands of people. And now—at least for some—there’s a replacement.

Replacement CPAP Machines Without Defect

On June 30, 2021, Philips Respironics announced a voluntary recall of about 15 million CPAP, Bi-PAP, and ventilator devices.

These machines contain a foam that breaks down over time. As a result, people using them may breathe in foam particles without realizing it. The particles include extremely dangerous carcinogens that can cause respiratory failure, cancer, and death.

Sleep apnea is serious, and if you had to turn in your old machine, you may have been left desperate for help. No one should have to worry their medical device might make them worse, but if you can’t trust those machines, what options do you have?

Now almost exactly a year after the recall, some CPAP machine users have reported receiving replacement devices that don’t have the foam defect.

Philips says they’ve shipped out 1.2 million replacements. As of June, they’d made 2.7 million new devices total. However, with 15 million devices recalled and a slower supply chain than usual, they still have a long way to go. They’ve only replaced about 7% of the devices so far.

If you need a replacement, make sure you’ve registered your recalled device here.

Personal Injury Lawyer Trenton, NJLawsuit for CPAP Injury

As of June, the FDA had received over 21,000 report of CPAP injury and over 100 deaths. Tragically, those numbers are still climbing.

The faulty machines have led to serious health conditions, including:

  • lung cancer
  • lung damage and lung disease
  • respiratory failure
  • acute respiratory distress
  • and even death.

What’s worse, we believe the company may have known for years that their devices could cause these injuries. It appears they may have chosen not to act on it until they had no choice: so many people and their loved ones complained that they were forced to issue a recall.

Regardless, the company is liable for their products and how they’ve hurt people. If you’ve been injured by a CPAP machine, you deserve compensation for your losses, and the company deserves accountability.

We can help. Our attorneys are now accepting clients who’ve used a CPAP machine and experienced any of the above injuries. We will fight for you and get you the justice you need and deserve. And we don’t get paid a thing until and unless you do.
