What are your chances of winning your Social Security Disability case in Tennessee?
Hi I’m Darrell Castle and I’m an attorney licensed to practice law in the state of Tennessee and the answer to that question is — your chances are EXCELLENT if you’re medically disabled and meet the qualifications to receive Social Security Disability Insurance. Then, your chances are very good. You have a very good chance to get it.
What are some of those qualifications?
Well first off, you have to be medically disabled. Social Security Disability Insurance is not for someone who just doesn’t want to work. It’s not for someone who gets laid off or is having a hard time. It’s for people who are MEDICALLY unable to work.
And that medical disability, or injury, or illness or whatever it is has to keep you from being able to train and transition into some other area of employment. It has to be that severe.
Third, it has to be something that’s expected to last for at least one year.
Finally, you have to meet the income qualifications. What are those? 40 credits. How do you get a credit? You can get up to 4 credits a year. That’s a minimum. So you can get 4 of those a year, and in theory make $4,800 in a year, then you qualify for that year’s credits.
How many do you need? 40. So what’s that mean? You have to work for 10 years.
And 20 of those credits – or half – you have to get within the last 10 years. You can’t stop working and then 10 years later apply for disability. It doesn’t work.
So all of those things seem pretty complicated, folks. It’s not that compacted. You just need to see someone who knows that they’re doing. It’s possible to have your disability granted. Sometimes you have to file an appeal. You need to see somebody and get help.
