“You’ll be okay – just take two aspirin and call us back in the morning.”
That’s what a doctor said (paraphrased) to a 50-year-old man visiting for crushing chest pain.
When the man got home, one of his arteries exploded and he died.
When we took on this case, we reached out to experts from Vanderbilt University Medical Center. We received affidavits from those experts claiming that if the doctor above had just done a routine cardio workup as was indicated from his symptoms, he would have had an 80% chance of survival. Instead, the cardio workup wasn’t done and the man died.
The man had an aneurysm in his chest that was on the verge of rupturing. This was not caught, however.
Doctors in the emergency room see many cases that turnout to be nothing. This can lead to assumptions that the next patient has nothing major wrong with him/her, as what could have been the case in this man’s situation above.
We settled this case, but it wasn’t easy.
Medical malpractice cases are difficult – there’s just no other way around it. It’s not simply seeing a doctor and receiving a bad result.
In order to have a medical malpractice case, you have to be able to prove that any reasonable doctor would have done things differently than the doctor in question. Not just one doctor. Not just two doctors. But ANY reasonable doctor.
The law in Tennessee now is you can’t file a medical malpractice case unless you have two different affidavits from qualifying experts. To be “qualifying,” these experts must have knowledge of your state’s medical practices.
