What is Personal Injury?

Posted on December 19, 2015
The Basics of Personal Injury Personal injury, as defined by Merriam-Webster, is “an injury affecting one’s physical and mental person as contrasted with one causing damages to one’s property.” Basically, if someone else’s negligence causes your injury, then that’s personal injury. If someone ran a red light and slammed into your car — injuring you — then that’s personal injury. If you slipped and injured yourself on water in a restaurant, then that’s personal injury. If your elderly mother was abused and injured in a nursing home, then that’s personal injury. And there are many other types, which I’ll talk about in a bit.   Why Should Make a Personal Injury Claim? When you’re injured in an accident, you’ll likely

What you should know about premises liability By: Darrell Castle Premises liability is a case where you’re injury is actually caused by the premises or something about the premises (a building, retail establishment, something of that nature).Let’s say you’re shopping, and the place where you’re shopping negligently leaves something on the floor, and you step in it, fall down, and injure yourself; or you’re in an establishment that should have security, and you’re injured there and the security was improper – that would be an example of a premises liability. So it’s those types of things, where the premises itself is actually the cause of the injury. What Should I Do If I’m Injured by a Premises Liability? If you’re inside

In personal injury civil lawsuits, there is a statute of limitations that varies according to the state and the cause of injury. The statute of limitations is a set amount of time in which you can file a suit before your case expires. The statute can be very straightforward. Let’s say, for example, that you suffer from a swimming pool injury because the diving board broke at the local community center. The cause of your injuries should be very obvious, and you can and should get started talking with a personal injury lawyer quickly. In Tennessee you will typically have about a year after that initial accident to file your case (although you’ll sometimes have more). But what happens when

What is Workers’ Compensation?

Posted on December 19, 2015
Workers’ compensation (also known as workers’ comp) is a type of insurance available to employees of a company when they are injured on the job. It may include wage replacement and medical care for expenses stemming from the injury. It can also sometimes function as life insurance when a worker dies because of a job-related injury. Through workers’ comp, after 14 days off due to injury employees can receive monetary compensation based on the percent of disability the injury causes. They’re also entitled to roughly 66% of their average weekly wages. If you’re injured on the job and seek workers’ compensation benefits, you typically waive your right to sue the employer for negligence. That waiver limits you from fighting for

What Makes a Good Dangerous Drug Case? Video Transcript: A good dangerous drug case has to be the right kind of drug that has been evaluated and shown to be a risk, and the person has to have suffered symptoms that are life-altering. Kidney failure and liver disease, I mean, and many, many different things that change a person’s life. It has to be serious, in other words. And then it has to be brought within a certain timeframe, because cases have limits. That’s called a statute of limitations, and it’s different in every state, but you have to bring your case within a certain limited time to make it valid legally. More questions?
