Do you need an attorney to apply for Social Security Disability Insurance?
Hi, I’m Darrell Castle and I’m an attorney licensed to practice law in the state of Tennessee, and the answer to that question is YES. And that is not just a self-serving answer on my part.
Applying for Social Security Disability benefits is a complicated matter and it requires a lot of information about you. About your injury. About your illness. About your medical records. And about your work history.
So to do that – to assemble all those things and do it the right way – you need an experienced Social Security Disability Insurance attorney.
If you do not have an attorney, here’s what will happen to you:
You’ll file your application probably thinking, well I’ve heard that everyone is turned down the first time anyway so I’ll just file the application. I’ll let the Social Security Administration people assemble all the evidence for it and then when they turn me down, I’ll hire an attorney for the appeal.
Well, #1 it costs you at least a year of time – at least a year of benefits you could be recovering. The best chance you have to actually win your case and get benefits is in the initial application process and in the hearing related to that application. You have to be able to put forth the effort and evidence to win.
If you are medically unable and you can prove that to the Social Security people within the confines of their rules and regulations, you should be granted disability benefits.
Now an attorney can do that for you. He can make sure the evidence is in the file. He can make sure you have doctor’s information and physicians reports. Not just medical records, but the proof it takes to win your case. The proof of what the regulations require of you. That is why you need an attorney
You may be worried about the attorney fee.
Well, it is cheaper to hire an attorney at the application process than it is at the appeals process.
Why?
Because his fee is based on past-due benefits. And there are far far fewer past due benefits at the application process, so it’s cheaper to hire him then and he can do the whole thing for you.
You need an attorney. Why waste that time? Why waste another year? Do it right the first time.
