Hello, I’m Darrell Castle and I’m an attorney licensed to practice law in the state of Tennessee and on this video today, I want to talk about why your disability claim — your claim for Social Security Disability — may have been denied.
And I have found that in my experience, one of the main reasons is that the applicant — that would be you — does not properly prepare the application. In other words, he tried to do it by himself rather than hiring a lawyer to help him. Especially since hiring a lawyer is so cheap and is not paid anything unless his application is successful.
So the person tried to do it by himself I guess in the expectation that the Social Security Administration would actually try to help him. That they actually wanted him to have benefits. But in reality, that’s not really the case. It is simply a bureaucracy.
You have to do the application properly and you can use an attorney on the front end. It’s very helpful, folks.
Reason number 2, you have to be medically disabled. You have to meet the requirements of medical disability. You have to be unable to work. Your doctor has to substantiate that.
And of course you have to meet all the standards of work time. You have to have 40 work credits. You can get 4 work credits per year. What’s that tell you? Well 10 years it actually takes to get those. And half of it has to be obtained within the last 10 years. So you can’t wait 15 years, then apply and expect to get disability.
All of those things can be explained to you by a competent attorney. That is the most important thing and the biggest reason why most disability claims are denied, because the person did not properly complete the application for disability. It’s very cheap to hire an attorney, folks. You need to do that.
