Does it matter for my car accident case that I wasn’t wearing a seatbelt?

 

It could matter if you’re not wearing a seatbelt during an accident – it could be a liability issue. Let’s say for example that you had some type of head injury from striking the windshield and you weren’t wearing your seatbelt. Well, that’s an issue that the other side is going to raise.

I don’t think it’s a deal-breaker type of issue, but it’s something that could be a factor in your accident, and it’s something the insurance company and their attorneys would want to raise as a possible element of damage or something.

But it’s not something to worry too much about. Just talk to your attorney about it. It’s just something he should be aware of so he’s ready to deal with it.
