Let’s talk about three ways a personal injury case can end

1. The case can be settled in favor of the plaintiff. As a personal injury law firm, the plaintiff is our client – the person who was injured.

This can happen when the defendant’s attorney offers an amount of money that we think is fair. If we think it’s fair, then we’ll recommend it to our client. The decision is ultimately his or hers.

2. The two sides can fail to reach an agreement. This can happen for a couple of different reasons.

If the defendant’s attorney, or insurance company, offers an amount of money that we don’t think is fair, then the case can go to trial to be decided by a jury.

The case can also be decided by a jury if the two sides cannot agree on who’s liable for the accident.

3. The plaintiff attorney decides not to go forward with the case. If the attorney can’t prove liability or there’s no money at the end of the road, then a good attorney will advise his client not to go forward.

This might sound bad at first, but it’s actually a good thing. If there’s no liability or no money to be recovered even if you win, then it’s unethical for an attorney to drag his or her client through litigation that’s going to eventually amount to nothing. It’s too expensive and it’s ultimately a waste of time.

With that said though, you should always speak to an experienced personal injury attorney if you think you have a case. An experienced attorney will look at your case detail by detail, investigate the facts and the law, and determine if there’s liability, if you’re entitled to compensation and how much.
