What to do when Medical Errors occur

We’re all humans, therefore we all make mistakes. However, some mistakes are much more costly, especially when it comes to medical professionals botching a procedure.

The room for error is small, if not non-existent, when you’re a doctor, whether it be a surgeon, or one in family practice. Patients trust these professionals to fix them, and if they can’t do that, it’s one thing, but if they make things worse, then it’s another.

However, medical malpractice does happen (again, we aren’t perfect), and because of this, doctors carry malpractice insurance.

Knowing doctors have this insurance, people shouldn’t feel bad for suing someone who misdiagnosed their condition leading to bad outcomes, or an operation went terribly wrong causing them to lose a loved-one.

However, it’s important to know what you’re implying when you sue a doctor for medical malpractice. You’re implying that doctor acted outside the standard of care that any other reasonable doctor would have acted in, which must be backed up by a documented medical expert witness claiming just that.

A doctor being rude or an unfavorable result isn’t malpractice. Things happen and treatment doesn’t always go the way you’d like.

But, did a medical procedure go wrong? Did this wrongdoing cause disability or suffering? Was the doctor negligent? Can negligence be proven?

If you can answer those questions with a “yes,” then you have a good case and shouldn’t feel bad for suing the doctor. Because of his or her negligence, your life has been altered. That doctor should be held accountable for his or her mistake and you shouldn’t be held liable for medical costs, pain, suffering and whatever else you’ve been through as a result.
