What if a driver has a heart attack on the road? A stroke? What if they have a less serious problem that’s still dangerous when driving a car? For example, what if a driver suddenly breaks into uncontrollable sneezing or coughing? There are times when a car accident isn’t really anyone’s fault at all. No one made a mistake, everyone was being careful, and then suddenly you’re hurt in a wreck and wondering what to do. In situations where someone had a medical problem that caused the accident, it’s that person’s insurance company who is responsible for any damage, injuries, etc. Everyone else should be focused on getting better. Unfortunately insurance companies don’t always make it so easy. They sometimes
By: Darrell Castle Airbag and seat belt technology in this day and age are very sophisticated, but when they don’t work, bad things happen. Yesterday, I told you a story about my drive down Wolf River in Germantown and my witnessing of a high-impact car accident in which an SUV full of teenagers collided with a parked truck. To my pleasure and surprise, no one appeared injured. I chalk the seemingly nonexistence of injuries in this car accident to the use of seat belts and the abilities of the air bags that deployed. Though I’m not certain, it’s rational to conclude those two things saved these drivers and passengers from any bad injuries. However, as a car accident attorney and
Metal medical device replacements have come with complications By: Darrell Castle Stryker and Depuy Orthopedics are two separate medical replacement device companies. These two companies proposed and promoted an alternative to the traditional hip replacements – metal replacements. They promoted the metal replacements as a longer-lasting option. However, their metal knee and hip replacements weren’t adequately tested before being released to the market and have been linked to many problems. This has led to lawsuits against Depuy Orthopedics and Stryker claiming their products are defective. Darrell Castle & Associates has been successful in helping victims receive compensation for damages associated with the use of Depuy medical replacement devices. We are investigating both Depuy and Stryker devices and still taking cases.
Misdiagnosis happens far too often By: Darrell Castle If misdiagnosis isn’t the number one cause of medical malpractice, then it’s definitely up there near the top. Misdiagnosis, or delayed diagnosis, happens far too often. And it can be very dangerous. Take this case my law firm had as an example. A man in pain went to the hospital with classic heart attack symptoms, but was sent home after being diagnosed with simple indigestion. That night, the man died of the heart attack symptoms that were overlooked. The man’s wife was awarded a high six-figure verdict in damages from the medical negligence. If your condition is misdiagnosed, then you may miss treatment vital to your health, and in some cases, even
Getting from debt to retirement can be simple The age of 65 is widely-regarded as the retirement age, or very close to it. That means if you’re 60 years old, you should have a pretty comfortable nest egg and should begin brainstorming how much golf or volunteering you can fit into your napping and reading schedule once you retire. However, for many people, 60 years old doesn’t feel that way. Many 60 year olds are still in debt and don’t have a sustainable savings or retirement account. Is it too late then? NO! Actually, 60 is the new 40, and there’s a process to gain wealth in a relatively short amount of time if you’re 60 and in debt. The
Police officers have a duty to keep innocent drivers on the streets safe By: Darrell Castle Police departments all across Shelby and Desoto County have guidelines and policies in place to minimize the danger to innocent drivers on the roads during police pursuits and chases. “The position that ‘we always get our man’ does not justify the death or maiming of innocent people,” the Bartlett Police Department’s high-speed pursuit policy states. However, with high speeds, traffic build-up and an occasional override of the law, tragedies on the roads do happen and innocent drivers are hurt, or sometimes killed, by a police officer. That’s what happened this past week when a 63 and 49 year-old were killed after their car collided
Dangerous sidewalks in Memphis By: Darrell Castle In 2013, Memphis saw a big spike in sidewalk-related lawsuits, sparking interest and concern. It’s no secret that the City of Memphis has current budget issues. When you mix that with a bunch of messed up sidewalks, there’s going to be a problem. The city’s solution? Memphis residents were forced to repair sidewalks in front of their homes. However, many homeowners have complained they have insufficient funds to pay for sidewalk repairs, which can cost between $200-$1,500. At the beginning of July, council members extended the moratorium (or temporary prohibition) of forcing residents to repair sidewalks for two more months, according to the Memphis Flyer. Disfigured sidewalks can be dangerous for bicyclists, runners,

By: Darrell Castle You should contact an experienced car accident attorney if you were injured in a road accident. That’s true whether you know the accident was NOT your fault, or if you aren’t sure whose fault it was. An experienced car accident attorney will look at every detail of the case, find who was liable and determine if compensation should be awarded and how much. The attorney will investigate the accident by looking at police reports, watching any traffic camera recordings, talking to eye-witnesses and more. If the car accident wasn’t your fault, then you shouldn’t be liable for those medical bills. You should be compensated fairly for them, plus pain, suffering, lost wages from time off work and
