The dangers of drunk driving Did you know one-third of all roadway deaths are due to drunk driving? Overall, traffic fatalities have been decreasing to record lows, with cars becoming more and more safe through the years. However, those fatality numbers could continue to decrease if drivers start practicing accountability. In 2011, drunk driving was linked to 9,878 of the year’s 32,367 fatalities. In 2012, it was linked in 10,322 out of 33,561. The data shows the horror and tragedy of drunk driving’s effect on children: 20% of children 15 years old and younger who died in auto accidents are killed by drunk drivers. Of those children, 65% were riding in the vehicle WITH THE IMPAIRED DRIVER. 61% of those

You may have heard of nursing home abuse and neglect, or elder abuse and neglect. Whether it comes in the form of preventable bedsores, dangerous sleeping arrangements, physical assault, or something else, poor treatment in elder care facilities is serious. Our personal injury attorneys have worked with victims of nursing home abuse and neglect, and seeing what they and their families have gone through saddens and angers us. Recently the New York Times reported on a crisis happening in the state’s homes for developmentally disabled patients. While the cases it discusses are certainly extreme, the article brings to light another whole area of people who might be victims of abuse and neglect. Abuse can happen in hospitals, homes for challenged
In my personal injury practice, I take on something called nursing home abuse, which is when a facility for the elderly abuses or injures one of their residents. Last week two such cases crossed my desk that angered me to my core. The first case was a story out of North Carolina, where workers at an assisted living facility took pictures of a resident using the toilet and put them on social media. These stories boil my blood. Our elders are not only some of the most vulnerable people in our society – they’re also the people who birthed us, who fought for our country, who built our companies, who gave us what we have today. What is wrong with

Accidents Involving Big Trucks

Hello, this is Darrell Castle. I’m an attorney licensed to practice law in the state of Tennessee and on this video today, I’m talking about accidents involving large trucks – trucks that you might call semis or tractor trailers – that type of truck. If you’ve been a victim of an accident with one of those large trucks, or you know someone who has, then you’re probably wondering, what happened? What caused the accident? Every year, thousands of people are injured – catastrophically sometimes – even killed by these accidents and it’s really hard to determine what actually happened without an investigation. The Federal Highway Safety Administration tell us how to investigate these accidents. They tell us that there

Highway concerns grow after star actor is critically injured By: Darrell Castle This morning on the Today show, details were released in which state prosecutors claimed the truck driver who slammed into star actor Tracy Morgan’s limo, leaving him critically injured and another passenger dead, had NOT SLEPT in 24 hours, which raises highway safety concerns. It’s not like these concerns are anything new, but rather is a growing problem – one I’ve mentioned a lot through my videos and blogs. The facts from the video are terrifying: The typical trucker work week is nearly double the standard 40-hour work week. In 2012, 104,000 people were injured and nearly 4,000 people killed in crashes involving large trucks. That’s 11 people

Actos is a popular diabetes medication that’s been linked to bladder cancer. The FDA has published warning about it, saying that the drug especially increases bladder cancer risks for people who’ve taken it over a year. Bladder cancer survival rates differ according to when it is found and diagnosed. Treatment may include surgery or chemotherapy. It’s also a type of cancer that can recur years down the road and may require a lifetime of tests to make sure it doesn’t come back. A lot of people on Actos aren’t aware of the risks involved, and some people may even have bladder cancer without realizing the drug caused it. Now they’re stuck with a lifetime of medical bills because of another
Insurance company has filed a lawsuit against the manufacturer of Actos By: Darrell Castle It’s bad for everyone involved when an insurance company sues a drug manufacturer, yet that’s what’s happening as Blue Cross has sued Takeda, the manufacturer of Actos. Blue Cross’ lawsuit alleges that Takeda “concealed and continues to conceal their knowledge that Actos can cause bladder cancer from Plaintiff’s (Blue Cross) insured, other consumers and the medical community.” Blue Cross claims there are safer alternatives than Actos, used for type 2 diabetes, but because of Takeda promoting the drug as safe and effective, doctors and patients had no idea it was dangerous, nor there were better options. As someone who’s investigated Actos, I’ve found myself pretty upset
